§ 90.16 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ABUTS. At least one of the property’s boundary lines is defined by the lake.
   AUTHORIZED GUESTS. Persons who do not have a fee property interest in, nor the right to use and enjoy the real estate that abuts Clear Lake, but have occasional access to the property solely because they were invited by the owners. An AUTHORIZED GUEST is one that is usually accompanied by the owner or occupant of the real property on each occasion. In no event does the authorized guest have continuous permission to use and enjoy the land whenever he or she so chooses.
   BUSINESS ENTITY. A sole proprietorship, partnership, limited liability company, corporation, association of any kind, joint venture, or any business enterprise.
   COMMON AREA. Property that is designated for the use and enjoyment for all owners, occupants, or tenants of a residential subdivision, apartment building, condominium, cooperative, neighborhood association, organization, club, retirement community, or any other development of a similar nature, whether or not in existence at the time this subchapter was adopted.
   FAMILY. An individual or individuals related to each other through blood lines, marriage or adoption, and includes extended family members.
   HOTEL. A facility in existence as of the date of adoption of this subchapter, open to the public and dedicated to providing temporary lodging.
   MARINE. Any duly authorized, properly zoned facility dedicated to the storage, sale, maintenance or repair of watercraft.
   OCCUPY. To lease, rent, live on, or to be in possession of real property, whether lawfully or unlawfully.
   OWN. To hold property in fee simple, as tenants by the entireties, tenants in common, as life tenants, tenants for years, and holders of a remainder or reversionary interest.
   PERSON. An individual, partnership, association, corporation, company, organization, estate, trust, administrator, executor and/or trustee. It does not include a governmental entity or employee of any kind.
   PUBLIC LAUNCHING AREA. An area in use as of the date of adoption of this subchapter, designated by the town as a permitted area for the launching of watercraft.
   VALID EASEMENT. An easement which was properly filed and recorded before this chapter was adopted.
   YACHT CLUB. The Clear Lake Yacht Club, an existing organization qualified under Section 501(c) of the Internal Revenue Code.
