A. Powers And Duties: The position of Civil Infraction Hearing Examiner ("CIHE") shall be appointed by the City Manager to preside and conduct a hearing under this chapter related to the issuance of a notice of civil infraction. The CIHE may be a City employee, other than the enforcement official, or a non-City employed person with requisite skill and experience. A CIHE shall perform all duties and exercise all powers described in this chapter. The amount of a CIHE's compensation shall not be based directly or indirectly upon the outcome of cases heard by the CIHE. The duties of the CIHE may be performed through subordinates, except that a hearing shall be conducted only by a CIHE if a person charged with a civil infraction so requests in writing.
