9-1-11: PROHIBITED ACTS:
   A.   Water System:
      1.   Administrative Violations:
         a.   Turn On Water Without Authority: It shall be unlawful for any person, after the water has been turned off from his premises for either nonpayment of water or sewer charges as provided for in this chapter or for a violation of the rules and regulations pertaining to the city water and sewer systems, to turn on or allow the water to be turned on or used without authority.
         b.   Destruction Or Interference: It shall be unlawful for any person to destroy, deface, injure or interfere with the operation of any part, pipe, fixture, appliance or appurtenance of the city water system.
         c.   Water Meter Lids: It shall be unlawful to open or remove without permission water meter lids.
         d.   Administrative Fine: Violation of this subsection A1 will be an administrative violation that will attach to the real property upon which the violation occurs and shall subject the owner or tenant of the real property or both of them to an administrative fine only of not less than one hundred dollars ($100.00) nor more than two hundred fifty dollars ($250.00). Said fines will be in addition to any past due amounts for water or sewer services. A violation of this section may be proved by a preponderance of evidence.
      2.   Criminal Violations:
         a.   Deleterious Substances Introduced: It shall be unlawful for any person to place, cause to be placed or to introduce into the city water system or any source of water supplying said system any matter, substance, chemical or compound poisonous to human life, deleterious and harmful to human health.    B.   Sewer System:
      1.   Manhole Covers: It shall be unlawful for any person to open any sewer manhole without permission from the city.
      2.   Destruction Or Interference: It shall be unlawful for any person to destroy, deface, injure or interfere with the operation of any part, pipe, fixture, appliance or appurtenance of the city sewer system.
      3.   Injurious Substances: It shall be unlawful for any person to put into or cause to be put into or drained into the city sewer system through an authorized connection or otherwise, any pulp, mash, trash, inflammable gas, gasoline, oil, petroleum byproducts, any calcium carbide or residue therefrom, any liquid or other material which will evolve in inflammable gas when in contact with water, sewage or fire, or any other matter which by chemical reaction shall injure said sewer or any part thereof or the operation thereof, or which may become dangerous to health, life or property.
   C.   Notice Of Violation: Whenever the city shall determine that any of these provisions are being violated, notice shall be served upon the violator immediately to desist from the operation and use creating the violation. Failure to comply with such notice shall render the user immediately liable to a discontinuance of his or its privilege to use said sewer system. (Ord. 95-2, 3-14-1995)
