4-2-10: UNLAWFUL ACTS:
The following acts shall be considered unlawful:
   A.   Sales Or Furnishing To Intoxicated Persons: To sell, offer to sell, or otherwise furnish alcoholic beverages to any intoxicated person.
   B.   Minors:
      1.   To sell alcoholic beverages to any person under the age of twenty one (21) years.
      2.   For any licensee holding a class C or class D license hereunder to allow any person under the age of twenty one (21) years to be in, loiter about or to frequent the licensed premises.
      3.   For any person under the age of twenty one (21) years to be involved in the retail sale or service of alcoholic beverages, except those class A licensee employees otherwise authorized by law.
   C.   Sales Upon Licensed Premises: For any licensee to sell alcoholic beverages anywhere within the city except upon the premises of the licensed business.
   D.   Advertising: To advertise the sale of alcoholic beverages except in full compliance with the state's alcoholic beverage control act and regulations duly made therein by the state alcoholic beverage control commission; provided, however, that a simple statement that beer is sold under city license may be placed in the front window of the licensed premises.
   E.   Violate Terms Of License: For any licensee to violate any terms of the license issued.
   F.   Class A; Consumption On Premises: For any class A licensee to allow any person to consume beer upon the premises of the licensed business. It is unlawful for any person to consume beer upon said premises.
   G.   Food Offers: For any licensee to give away or offer any free lunch or other food with or in connection with the sale of alcoholic beverages.
   H.   Hours Restricted; Exception For Restaurants:
      1.   For any entity which holds a class A license to sell or otherwise furnish or dispose of alcoholic beverages between the hours of one o'clock (1:00) A.M. and six o'clock (6:00) A.M. Further, it is unlawful for any entity which holds a class B, C, D, or E license to sell or otherwise furnish or dispose of alcoholic beverages, or allow alcoholic beverages to be consumed on the premises or to allow alcoholic beverages to remain on that portion of the premises open to customers or members of the public between the hours of one o'clock (1:00) A.M. and ten o'clock (10:00) A.M.
      2.   Nothing herein contained shall prohibit the holders of a class B license from conducting a properly licensed restaurant after one o'clock (1:00) A.M., provided however, no alcoholic beverages shall be sold or consumed in violation of this chapter.
   I.   Impede View: For any licensee holding a class B, C, D, or E license to arrange or keep the licensed premises or any booth, stall, furniture, fixtures, screen or curtains therein so as to impede a full view of the premises and all of the occupants therein from the main floor entrance thereof.
   J.   Purchase Or Acquire Alcoholic Beverages: For any licensee to purchase or acquire or allow to be kept upon the licensed premises any alcoholic beverages, except those lawfully acquired from a brewer or wholesaler licensed under the provisions of the alcoholic beverage control act.
   K.   Gambling Or Gaming Device: For any licensee to have, possess, store or display upon the licensed premises any gambling or gaming device or any lottery tickets, or to allow any such device or tickets to be brought upon the premises for any purpose.
   L.   Barricades: For any door or entryway to be locked or barricaded in any way so as to interfere with the free entrance to the licensed premises by any peace officer at any time while the premises is occupied or open to the public. However, there may be maintained upon the premises a locked storeroom for the keeping of goods and supplies used in the business. Such storeroom shall at all times be subject to search and inspection by any peace officer and it is unlawful for any licensee to deny any peace officer immediate access to such storeroom upon demand.
   M.   Lookout: For any person commonly known as a "lookout" to be stationed or maintained to give warning of the approach of any peace officer. It is unlawful to maintain or operate any device which is used or capable of being used to give warning to persons within such licensed premises of the approach of any peace officer.
   N.   Disorderly Conduct: For any licensee to allow any disorderly conduct to be committed or to allow any disorderly person to be or remain upon the licensed premises.
   O.   Sales After Revocation Or Suspension: For any person to sell alcoholic beverages after the revocation or suspension of any license issued to him.
   P.   Control Of Conduct: For any licensee to fail to maintain full control of the conduct of the business upon the licensed premises or to fail to inform himself of the manner in which said business is conducted and of the activities of his employees in and about the licensed premises. The licensee shall be responsible under this chapter for all of the activities of his employees, and hereunder the licensee unconditionally guarantees to the city that neither he nor his employees will violate the terms of this chapter and for breach of such guarantee, the license may be revoked.
   Q.   Open Container: No on or off premises beer retailer or its employees shall permit a patron or attendee to carry from the premises an open container that is used primarily for drinking purposes and contains any alcoholic beverage. (Ord. 2008-04, 7-22-2008)
