2-2A-1: CREATED:
   A.   Established: Pursuant to the Utah state disaster recovery funding act, the city's chief financial officer is authorized and directed to establish a special restricted internal services fund for the purpose of creating and accounting for a local government disaster fund for the city.
   B.   Restrictions: The city's disaster fund, its use and any deposits or transfers made thereto, shall be subject to the restrictions set forth in the state's disaster recovery funding act as well as the following:
      1.   Deposits And Transfers:
         a.   Amounts transferred to the city's disaster fund in any given fiscal year shall not exceed ten percent (10%) of the total estimated revenues (unrestricted or not otherwise obligated) for the city during that same fiscal year.
         b.   Monies received from outside public or private sources given to the city for purposes consistent with this section which are then deposited into the city's disaster fund either at the direction of the city council or by request of the donor shall not be counted toward the maximum annual deposits allowed as described in subsection B1a of this section.
      2.   Use: Any monies in the city's disaster fund may only be used to fund services and activities of the city in response to:
         a.   A declared disaster within the city's boundaries;
         b.   The aftermath of the disaster that gave rise to a declared disaster within the city's boundaries; and
         c.   "Emergency preparedness" as defined in section 53-2-402 of the Utah state disaster recovery funding act as amended, except that not more than ten percent (10%) of monies budgeted to be deposited in a given fiscal year may be spent on emergency preparedness during that same fiscal year.
