§ 34.33 DEATH.
   Whenever a town employee shall die without having received an annuity, an amount equal to the total of his or her accumulated deductions shall be paid in 1 lump sum to the beneficiaries designated for the employee in his or her will, or if none, to the legal representatives of the employee upon the establishment of a valid claim therefor. Upon the death of any emeritus employee receiving a pension from the town, no further payments of the pension shall be made to the heirs of the emeritus employee except that if the emeritus employee has not received in pensions a sum equal to the total principal sum contributed by him or her to the Retirement Fund, then the balance thereof remaining shall be paid by the Town Clerk-Treasurer to the widow of the emeritus employee, or if none, then to the person duly qualified under the laws of this state to administer upon the estate of the deceased emeritus employee. Payment to the widow or to the duly qualified person as aforesaid shall be conclusive upon all persons claiming any interest whatsoever in the deceased emeritus employee’s estate.
