(A) Incomplete submittals will not be accepted for review.
(B) The subdivider shall submit all required materials to the Town Manager.
(C) The Town Manager shall review all materials and shall request a review and response from applicable town departments, other governmental agencies, and utility companies within two working days from the date the application is determined to be complete. All reviewing agencies shall have a minimum of 21 working days to review and comment on the subdivision. Within 5 working days of receiving a written report, comment or recommendation from any town department, governmental agency, or utility company, the Town Manager shall make a copy of such materials available to the subdivider.
(D) The Town Manager shall have the right to require that the subdivider provide additional information or to make amendments to the plat and supporting information if the Town Manager determines by a review of the materials or from comments received from reviewing entities that the submittal is incomplete, incorrect, or invalid.
(E) The subdivider shall have 10 working days in which to make any corrections or additions required by the Town Manager, or to request a postponement of action by the Town Manager for up to 90 days.
(F) If a subdivision application does not meet the requirements of this Code within 365 days of its original submittal, the Town Manager shall summarily reject the application and notify the applicant in writing of the reasons for the rejection.
(G) If a submittal meets all requirements of this Code within 365 days of its submission to the town, the Town Manager shall inform the subdivider of the status of the submittal, and within 3 days of notifying the subdivider, place the proposed subdivision on the agenda of the next Planning and Zoning Commission with a recommendation of approval or conditional approval.
(H) Notice of consideration of the proposed subdivision shall be sent by certified mail to the owners of land within 100 feet of the boundaries of the proposed subdivision, excluding public right-of-way, at least 15 days prior to the meeting at with the subdivision is to be considered.
(I) The Town Manager shall maintain custody of the preliminary plat.
