§ 114.01 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context indicates or requires a different meaning.
   ADULTERATED. Food shall be deemed to be adulterated in any of the following cases:
      (1)   If any substance or substances has or have been mixed and rucked with it so as to reduce or lower or injuriously effect its quality or strength;
      (2)   If any inferior or cheaper substance has been substituted wholly or in part for the article;
      (3)   If any valuable constituent of the article has been wholly or in part abstracted;
      (4)   If it consists wholly or in part of filthy, diseased, decomposed, putrid or rotten animal or vegetable substance, whether manufactured or not, or of any portion of any animal unfit for food, or if it is placed or packed in an unclean container, or if it is a product of a diseased animal, or 1 that has died otherwise than by slaughter;
      (5)   If it is colored or coated or polished or powdered whereby damage or inferiority is concealed or it is made to appear better than it really is;
      (6)   If it contains any added poisonous ingredients, or any ingredient which may render it injurious to health; or if it contains any antiseptic or preservative not evident and not known to purchaser or consumer; and
      (7)   If it does not conform to the standard of purity therefor as proclaimed by the Secretary of the United States Department of Agriculture.
   EATING AND COOKING UTENSILS. Any kitchenware, tableware, cutlery, utensils, containers or other equipment with which food or drink comes in contact during storage, preparation or serving.
   EMPLOYEE. Any person who handles food or drink during preparation or serving, who comes in contact with any eating or cooking utensils, or who is occupied or employed at any time in a room in which food or drink is prepared or served.
   HEALTH OFFICER. The County Health Officer in and for Union County, New Mexico, the Sanitary Inspector or any officer, official or employee of the Town of Clayton, charged with the enforcement of health measures, ordinances or regulations, or the authorized representative of either of them, as the context renders applicable.
   PERSON. Person, firm, corporation or association.
   RESTAURANT. Restaurant, coffee shop, cafeteria, short-order café, luncheonette, hotel dining room, tavern, sandwich stand, soda fountain and all other eating and drinking establishments.
