For the purpose of this subchapter, the following definitions shall apply unless the context indicates or requires a different meaning.
ALCOHOLIC LIQUORS. Any and all distilled or rectified spirits, potable alcohol, brandy, whiskey, rum, gin, aromatic bitters bearing the Federal Internal Revenue Strip Stamps or any similar alcoholic beverage, including all blended or fermented beverages, dilutions or mixtures of 1 or more of the foregoing, containing more than 0.5% alcohol, but excluding medicinal bitters.
CLUB. Any organization of persons organized and operating under the laws of the State of New Mexico, to which the state has issued a liquor license.
DISPENSER. Any person, to whom the State of New Mexico has issued a dispenser’s liquor license, selling, offering for sale or having in his or her possession with the intent to sell alcoholic liquors by the drink or in packages containing less than 5 gallons.
GENERAL ELECTION DAY. Any day during which there is a general election of officials to state, county or municipal offices.
MINOR. Any person under 21 years of age.
PERSON. Any male or female, corporation, firm, co-partnership, association or club and shall include both the singular and plural numbers.
RETAILER. Any person, to whom the State of New Mexico has issued a retailer’s liquor license, selling, offering for sale or having in his or her possession with the intent to sell, any alcoholic liquors for consumption off of the premises of the licensee and in unbroken packages containing less than 5 gallons.
SUNDAY. The time between 2:01 a.m. of Sunday and 12:01 a.m. of Monday.
