(A) Clayton Memorial Cemetery is an endowed care cemetery. This care is made possible under an arrangement whereby a portion of the purchase price realized from the original sale of any plot is placed in a trust fund. Income from this trust fund is used to permanently maintain the cemetery. The income from this trust fund is expended for the specified purpose by the Town of Clayton. Care and maintenance shall be provided only in so far as the net income from the amount deposited in the trust fund will permit.
(B) This chapter and enforcement of this chapter is intended to protect the cemetery and create and preserve its beauty. All owners of lots, all visitors and those performing work within the cemetery shall be subject to this chapter.
(C) All persons entering the cemetery shall obey this chapter.
(D) The Clayton Memorial Cemetery will not be liable for any act of lot owners, visitors or trespassers within the cemetery, for any damage to person or property within the cemetery, nor shall it be liable for any damage caused by the elements, an act of God, common enemy, thieves, vandals, strikers, malicious mischief makers, explosions, unavoidable accidents, invasion, insurrections, riots or order of any military or civil authority, whether the damage be direct or collateral, other than as herein provided.
(E) The Clayton Memorial Cemetery reserves the right to lay, maintain and operate, or alter or change pipelines for sprinkling systems, drainage, roads and etc. The cemetery reserves the right of ingress and egress over the lots for the purpose of passage to and from other lots.
(F) When all the gates are locked the cemetery is closed. It is a violation of this ordinance for anyone to be in the cemetery when it is closed. The cemetery will typically be open during daylight hours.
