§ 96.04 UNNECESSARY AND IMPROPER NOISES.
   (A)   It shall be unlawful for any person or persons to make, assist in making or allow or cause to be made unnecessary or improper noise or disturbance within the Town of Clayton, New Mexico.
   (B)   UNNECESSARY OR IMPROPER NOISE OR DISTURBANCE is defined to mean and include:
      (1)   The use and operation of any phonograph, radio or combination of the same so that the sound there from is projected immediately into the street by means of a street speaker. STREET shall be deemed to include sidewalk, and this section shall be construed so as to prohibit what is commonly called a “street speaker”, by whatsoever name known, by which sounds therefrom are projected immediately into the street, and shall also be deemed to include any radio or phonograph or combination of the 2 or the reproducing unit thereof when so placed in any doorway or opening of any building or business establishment within the Business District of the town so that the sound therefrom is projected immediately into the street. BUSINESS DISTRICT is defined as set forth in § 95.35;
      (2)   The unnecessary blowing or sounding of an automobile or other vehicle horn or warning device; and/or
      (3)   The operation of a motor vehicle upon the street with the muffler cutout open so that the exhaust does not go through the muffler.
