All sidewalks, except in the Business District, shall be built in 1 of 3 ways:
(A) According to the standard section on file in the Town Office, i.e., the sidewalk shall be placed 2 feet from the property line, and 4 feet wide extending toward the street. All curbs shall be 10 feet from the property line, in the 80 foot streets and 20 feet from the property line, in the 100-foot streets, leaving 60 feet of clear roadway in both cases.
(B) In the event a majority of the owners on 1 side of any street, avenue or highway in any block in the town agree in writing that their sidewalk should be immediately adjacent and against the curb of the street, avenue or highway, the writing shall be filed with the Town Clerk-Treasurer, whereupon they shall be entitled to construct a sidewalk 3-1/2 feet wide and 4 inches thick immediately adjacent to and against the curb line on the side of the street adjacent to their properties; provided, that if any sidewalk shall already exist along any part of the block on the same side of the street as the lots of the consenting property owner, they must obtain permission in writing from the owners of the lots adjacent to the sidewalks already in place, to destroy the same and construct a new sidewalk adjoining the curb line; if the permission cannot be obtained, then no sidewalk on the street, avenue or highway may be constructed next to the curb along the front lines of the lots fronting upon the street, avenue or highway, but any sidewalk shall then be constructed only in line with the existing sidewalk already in place, unless the existing sidewalk shall be in such poor condition that same shall be condemned by the Town Engineer as hereinafter provided; likewise, if a sidewalk exists next to the curb in part of any block, the remainder of the sidewalk on same street in the block must be constructed next to the curb.
(C) In the event any property owner desires to construct a sidewalk next to the curb line along the side line of his or her lot, where he or she owns up to the alley the entire lot whose side line is immediately adjacent to the street, avenue or highway, in the town, he or she may at his or her option construct a sidewalk either as provided in division (A) above, or the sidewalk 3-1/2 feet wide and 4 inches thick adjacent to and against the curb line of the street, avenue or highway; provided that no sidewalk next to the curb shall be constructed as provided in division (B) above or this division, unless the curb and gutter have already been constructed or are constructed at or about the same time as any sidewalk immediately adjacent to the curb.
