§ 31.07 OFFICERS FOR ELECTRIC LIGHT SYSTEMS.
   (A)   The Superintendent shall employ 1 or 2 assistants, subject to the approval of the Mayor and Board, who shall, under the direction of the Superintendent, have charge of the engines, pumps and machinery connected with the Electric Light and Water Systems, keep the same in order and ready at all times for service and manage the same while in operation. They shall, in addition, have authority to tap all mains and distributing pipes and insert the ferrules and corporation cocks and be subject to the orders of, and under the supervision of, the Superintendent in all matters.
   (B)   (1)   The Superintendent shall, under the direction and supervision of the Mayor or the Managing Trustee, have general management and control of the Water and Electric Light Systems of the Town of Clayton, New Mexico and shall have authority to fix the rates, within the limits as may be prescribed by ordinance to be paid by the inhabitants of the town for the use of water, water meters, electric lights, motors, light meters and hydrants. He or she shall make a detailed report to the Board of Trustees at least once every 6 months of the condition of the systems and of all mains, pipes, hydrants, reservoirs, machinery, poles and light lines and recommend any improvements, repairs and extensions as he or she may think proper.
      (2)   He or she shall furnish the Managing Trustee with additional reports at any time as they may be called for.
      (3)   He or she shall also perform any other duties as may be required of him or her by ordinance, and he or she is authorized, whenever the public good demands, to employ additional laborers to assist him or her. All requisitions for material and supplies for the systems shall be made by the Superintendent in duplicate, the duplicate copy to be retained in his or her office, the original copy to be approved by the Managing Trustee, then turned over to the Town Clerk-Treasurer of the Town of Clayton as his or her authority for making the order. The Superintendent shall keep a book at the plant in which all work shall be recorded as it is done. All material and supplies received, all trouble and repair work attended to shall be recorded thereon. The Superintendent shall keep in duplicate, a record of each installation of water or electric lights and each repair job showing quantity and amount of material taken out on the job and the time spent by each person. One copy of the above is to be retained in his or her office, the original copy to be given the Secretary and Collector for making the proper charges and collections. The Superintendent shall make all estimates in duplicate, 1 copy to be given the customer and the other to be retained in his or her office. All the records of the Superintendent shall be open for the inspection of the Managing Trustee or Mayor at any and all times. The Superintendent shall check and approve all time sheets, bills for material, labor and supplies received for the Water and Electric Light Systems, turning the same back to the Town Clerk-Treasurer after they are checked and approved.
   (C)   The Board of Trustees shall elect or appoint a Secretary and Collector for the Water and Electric Light Systems, who shall hold his or her office during the pleasure of the Board of Trustees, provided that he or she shall not be removed except for cause.
   (D)   The Secretary and Collector shall execute a surety bond to the Town of Clayton to be approved by the Mayor and Board of Trustees, in the sum of $1,000, conditioned that he or she will faithfully discharge the duties of his or her office and account for and turn over to the proper authorities all monies, books and papers which may come into his or her hands by virtue of his or her office.
   (E)   The Collector and Secretary shall open an account in a book or ledger provided for that purpose with each water or electric light consumer in the town, and keep a just and accurate account with each. He or she shall collect all monies receivable by the town on account of the systems and faithfully account for same, and pay the same over to the Town Clerk-Treasurer of the Town of Clayton each and every month taking his or her receipt in duplicate and filing 1 of the same with the Town Clerk-Treasurer. He or she shall report to the Board of Trustees by day 15 of each month the total amount due to the town at the close of the preceding month, the amount paid on that month’s bills and the amounts paid on the bills of the preceding months. All supplies for his or her office shall be ordered by the Town Clerk-Treasurer on the requisition of the Collector and Secretary when approved by the Managing Trustee. He or she shall report at the close of each month the names and amounts of each customer 30 days or over in arrears with his or her bills. All bills or charges against consumers for water, electric lights, supplies or charges of whatever nature shall be made in duplicate and numbered. The original to be given the customer when paid, the duplicate to remain permanently in the book. All books, papers and records of the town shall be opened for the inspection of the Managing Trustee or Mayor at any and all times. The Secretary and Collector shall perform the other duties as may be required of him or her by ordinance.
