§ 31.01 CODE ENFORCEMENT OFFICER.
   (A)   The position of Code Enforcement Officer is hereby established.
   (B)   The Code Enforcement Officer shall be designated by the Chief of Police with the approval of the Mayor and shall be subordinate to the Chief of Police.
   (C)   The Code Enforcement Officer shall have authority to investigate, issue citations and prosecute violations in Municipal Court on the following matters:
      (1)   Junk on vacant lots;
      (2)   Weeds;
      (3)   Addressing;
      (4)   Signage;
      (5)   Setbacks, fences and nonconforming uses;
      (6)   Junk and abandoned vehicles; and
      (7)   Sidewalks, curbs and gutters; including without limitation in §§ 94.22, 95.35, 96.01, 96.06, 150.01 and 154.01 and to investigate dangerous buildings and debris and refer matters to the Board of Trustees for action under NMSA § 3-18-5.
   (D)   The duty and authority given hereby to the Code Enforcement Officer is in addition to the authority of town police officers to investigate, issue citations and prosecute in Municipal Court any of the matters identified in this section, and nothing in this section limits the ability of any town employee or official to perform any duty or exercise any authority provided by statute, other ordinance or other law.
