(A) The town shall have a lien upon any lot or subdivision of the town for all legal charges for water or electricity furnished by the town and used upon the lot or subdivision, or in or upon any building or buildings, thereon situate; provided, that whenever any building, lot or subdivision in or upon which water or electricity or either or both are being used shall become vacant, it shall be the duty of the owner of the former tenant to give notice in writing to the town that the property is vacant, and when the notice is given, no lien for water or for electricity furnished after 3 days from receipt of the notice shall be had against the property.
(B) The lien may be enforced by appropriate suit in the District Court of Union County, New Mexico, in which county the town is located.
