The owner of a building or structure or any other person may appeal from a decision of the Building Official refusing to grant a modification of the provisions of this subchapter covering the manner of construction or materials to be used in the erection, alteration or repair of a building to the Board of Appeals. Application for appeals may be made when it is claimed that the true intent of this subchapter or the rules legally adopted under this subchapter have been incorrectly interpreted, or the provisions of this subchapter do not fully apply, or an equally good or better form of installation or construction can be used. No appeal alters the effect of a stop-construction order issued by the enforcing agency nor prevent the enforcing agency from seeking a court order enjoining any particular alleged violation.
