A. Title: This Section shall be known as the CLAY COUNTY ALCOHOL CONTROL ORDINANCE.
B. Prohibitions:
1. Use Or Possession By Minor: It shall be unlawful for any person under the age of twenty one (21) to purchase, obtain, possess or consume any alcoholic beverage in the County.
2. Provide Or Give: It shall be unlawful for any person to provide or give a person under the age of twenty one (21) any alcoholic beverage in the County.
3. Parental Responsibility: It shall be unlawful for any parent or legal guardian to knowingly permit his or her child or a minor under his or her custody, supervision and control to violate any provision of this Section.
4. Allowing To Remain: It shall be unlawful for any owner or occupant of any premises located within the County to knowingly allow any person under the age of twenty one (21) years to remain on such premises while in the possession of alcoholic liquor or while consuming alcoholic liquors in violation of this Section.
5. Operation Of Motor Vehicle: Parents or legal guardians who know, or in the exercise of ordinary care should know, of a substantial probability that their minor child has consumed or will consume alcoholic liquor, whether in violation of this Section or other law, shall restrain or prevent their minor child from driving, operating, or being in physical control of a motor vehicle in the County. C. Penalty:
1. Violation; Penalty: Any person who is convicted of a violation of this Section is guilty of a misdemeanor and shall be subject to penalty as provided in Section 1-4-1 of this Code.
2. Juvenile Violation: Upon a juvenile being found guilty for violating this Section, there shall be imposed the penalties under Minnesota Statutes Annotated, section 260.195. (Ord. 1996-1, 7-2-1996, eff. 7-2-1996; amd. 2000 Code)
