6-1-5: CERTIFICATION INSPECTION REQUIRED:
   A.   When Required: A certification inspection shall be completed upon:
      1.   Transfer of ownership of a parcel of property:
         a.   It is the responsibility of the seller to provide to the buyer a copy of the certification inspection indicating whether the system is in compliance or noncompliance prior to signing an agreement to sell or transfer real property. During the period between November 1 and April 30, a request for a certification inspection must be submitted to the Clay County Environmental Services Division office prior to signing an agreement to sell or transfer real property and the associated inspection completed by July 1;
         b.   A contract for deed is considered a transfer of property whether it has been filed or not;
      2.   Receipt of a nuisance complaint;
      3.   Observation by environmental health personnel of any failure as described below; or
      4.   Request of the property owner.
   B.   Term Of Validity:
      1.   Existing System: A certification of an existing system is valid for three (3) years from the date of issuance unless the local unit of government finds evidence of an imminent threat to public health or safety requiring removal and abatement under Minnesota Statutes Annotated section 145A.04, subdivision 8.
      2.   New System: A certification for a new system is valid for five (5) years from the date of issuance unless the local unit of government finds evidence of an imminent threat to public health or safety requiring removal and abatement under Minnesota Statutes Annotated section 145A.04, subdivision 8.
      3.   Recertification: A recertification inspection may take place within the time frames listed above at the request of the property owner, upon receipt of a nuisance complaint or upon observation by environmental health personnel of any failure as described below.
   C.   Authority To Inspect: The Director of the Environmental Service Division of the County Health Department, or an authorized representative, shall complete all certification inspections in the County. (Ord., 1-27-1998)
