If the owner or occupant of the premises on which such nuisance shall be situated shall neglect or refuse to remove the same for the space of twenty four (24) hours after such notice is given or within the time specified therein, he shall be guilty of a misdemeanor and be liable for the expense of removing such nuisance and the costs of the prosecution.
