3-3-6: VIOLATION; PENALTY:
   A.   False Statements; Noncompliance: It is unlawful for any person to wilfully make any false or misleading statement for the purpose of determining the amount of any license fee provided for in this chapter, or to fail or refuse to comply with any of the provisions of this chapter to be complied with or observed, or to fail or refuse to pay, before it is delinquent, any license fee or penalty required by this chapter to be paid by any such person.    B.   Failure To Pay License Fees And Penalties:
      1.   Any machine owner who is delinquent in payment of fees and/or penalties required by this chapter shall be subject to any or all of the following: rendering the machine inoperable either by padlocking, shutting off power to it or some other means; confiscation of the machine and payment of storage and handling fees; or confiscation of all coinage and/or bills in the machine as security against the delinquent amount, until the amount owed the city, including penalties and interest, is paid.
      2.   If the machine is confiscated and the vendor wants to recover it and will not replace it in a Clatskanie business, a prorated license fee will be assessed according to the length of time it has been in use in the city, and when this fee, plus storage, and handling fees are paid, the machine can be returned. If the fees are not paid and the confiscated machine is not recovered by the owner within six (6) months, the machine will become the property of the city and may be disposed of as the city may see fit.    C.   Prosecution And Payment Unrelated: The conviction of any person for violation of any of the provisions of this chapter shall not operate to relieve such person from paying any fee or penalty thereupon for which such person shall be liable, nor shall the payment of any such fee be a bar to or prevent prosecution in the municipal court of any complaint for the violation of any of the provisions of this chapter.    D.   Penalty Imposed: Any person violating any of the provisions of this chapter shall, upon conviction thereof in the municipal court, be punished by a fine not to exceed fifty dollars ($50.00). Each day any person shall operate each machine for which a license is hereby required without having paid the license fee shall constitute a separate offense. (1996 Code § 5.12.050; amd. 2004 Code)
