3-3-4: LICENSE FEES; PAYMENT:
   A.   Fees Established: Each person operating one or more coin operated amusement devices shall pay a monthly fee for each device in accordance with a fee schedule adopted by resolution of the council. (1996 Code § 5.12.030)
      1.   Annual Payment In Advance:
         a.   "Payment in advance" means payment prior to the date first due, which is January 1 for annual payments.
         b.   If the amusement devices owned by the business plus the state owned video lottery type games used in the business equal more than eight (8) machines, the business owner may choose to pay annually in advance a maximum amount indicated as the "cap" in the fee resolution. If this amount is not paid in advance, the business owner must pay for each machine per month as if there were no cap. If these machines equal eight (8) or less, the business owner will receive a ten percent (10%) deduction if paid annually in advance.
         c.   If the number of amusement devices owned by a vending machine business and placed in the city equals more than eight (8) machines, the vendor may choose to pay annually in advance a maximum amount indicated as the "cap" in the fee resolution. If this amount is not paid in advance, the vendor must pay for each machine per month as if there were no cap. If these machines equal eight (8) or less, the vendor will receive a ten percent (10%) deduction if paid annually in advance. The vendor must provide the city with a list of the machines as well as the location.
      2.   Temporary Use Or Location: An amusement device owned and/or operated by a professional carnival, circus or other temporary operation must pay a minimum of one month's fee per coin operated amusement device. (Ord. 591, 12-3-1997)
   B.   Delinquency; Penalty:
      1.   Any license fee not paid within thirty (30) days of the due date shall be delinquent.
      2.   In the event any person hereby required to obtain a license shall fail or neglect to obtain the same before it shall become delinquent, the city recorder shall collect, upon payment therefor, in addition thereto, a penalty of ten percent (10%) of the fee therefor for each calendar month or fraction thereof that the same shall be delinquent.
   C.   City Liability; Authority To Change Fees:
      1.   Nothing contained in this chapter shall be taken or construed as vesting any right in any license as a contract obligation on the part of the city as to the amount of the fee under this chapter.
      2.   The fees provided for in this chapter may be increased or decreased and additional or other fees provided for and levied in any and all instances at any time by the city. (1996 Code § 5.12.030)
