3-1-5: APPLICATION REVIEW:
   A.   Review Criteria: The City Manager shall not approve a business license application, unless the City Manager finds that:
      1.   The business is in compliance with all applicable provisions of the City Code and State of Oregon law;
      2.   The application is complete;
      3.   The application is free of errors, false, or misleading material information;
      4.   The application is accompanied by the applicable fee; and
      5.   All outstanding fees, penalties, and fines due to the City under any code provision have been paid.
   B.   The City Manager may request additional documentation or information to determine the qualification of the applicant for a business license.
   C.   If an applicant fails to respond to a request for additional documents or information within thirty (30) days or otherwise fails to pursue approval of an application for thirty (30) days, the application is deemed withdrawn. No fees shall be refunded.
   D.   A person whose application for any business license has been denied or whose license has been revoked two times within one (1) year, or who has a total of four (4) denials or revocations, shall be disqualified from applying for a license for a period of two (2) years from the date of the last revocation or denial.
   E.   After the affirmative findings in subsection (A) and subsection (B) above, the City Manager shall deliver a business license to the applicant.
   F.   The City Manager shall provide written notice of denial of an application and notice of the opportunity to appeal as described under City Code § 3-1-11(D).
   G.   City shall not be liable for costs associated with any incorrect information provided by the applicant in an application. (Ord. 698, 8-5-2020, eff. 8-31-2020)
