ANNUAL CONTRACTOR LICENSE: | Means a contractor that operates consistently throughout the year. |
APPLICANT: | Means the agent or owner of the named business applying for a business license. |
APPLICATION: | Means the form provided by the City to apply for a business license. |
BUSINESS: | Means any person or their agent distributing goods or providing services within the City, including but not limited to contractors, property renters, landlords, delivery services, and e-commerce based services. The term "business" does not include public bodies and shall include but is not limited to: |
1. "Childcare provider" means a permanent business providing supervision and care for children in a dedicated building for that purpose. | |
2. "Commercial/industrial landlord license" means a person that rents or leases commercial or industrial property to others. | |
3. "Farmer's market license" means a license for organizing or otherwise operating a seasonal or year-round regularly scheduled market of goods, including markets for farm, produce, and art. | |
4. "Farmer's market vendor" means a person that operates a booth at a farmer's market for the sale of goods. | |
5. "Garage sale" means a selling of personal goods from a residence for less than three (3) days in a thirty (30) day period. | |
6. "Lodging business license" means a business that provides temporary overnight rooms for customers, including motels, hotels, and temporary residential lodging businesses. | |
7. "Nonprofit organization" means a bona fide organization with tax exempt status. | |
8. "Project contractor license" means a license for a contractor that operates in the City for between seven (7) days and six (6) months. | |
9. "Recreational vehicle park license" means a license for a business renting spaces for motorhomes, recreational vehicles, or camping sites. | |
10. "Residential landlord license" means a person that rents or leases residential property to others. | |
11. "Seasonal retail license" means a license for a retail business that operates less than six (6) months in a single year. | |
12. "Seven (7) day contractor license" means a license for a contractor that operates in the City for seven (7) or fewer consecutive days. | |
13. "Solicitation license" means a license for a business that conducts door to door sales. | |
14. "Temporary residential lodging" means renting rooms within a residential building to customers that are not members of the homeowner's family, including services provided through Airbnb, Inc. and similar businesses. | |
CITY: | Means the City of Clatskanie. |
IN-CITY BUSINESS LICENSE: | Means a business operating in the City with its headquarters in the City or with the City as its primary place of business. |
LICENSE or BUSINESS LICENSE: | Means the authorization granted for the carrying on of a business within the city limits. |
LICENSEE: | Means the business as specified and named by the applicant. |
NOTICE OF VIOLATION: | Means the official notice by the City Manager or his/her agent to a business operating in violation of this chapter. |
OPERATE A BUSINESS: | Means conducting business transactions within the City limits, including but not limited to the sale of goods, provision of services, or contracting with an e-commerce business to deliver goods or services within the City limits. |
OUT-OF-CITY BUSINESS LICENSE: | Means a license for a business operating in the City with its headquarters outside the City or with the City not as its primary place of business. |
PERSON: | Means all public and private corporations, including domestic and foreign corporations, firms, partnerships of every kind, associations, organizations, syndicates, joint ventures, societies, and any other group acting as a unit, and individuals transacting and carrying on any business within the City. |
RENEWAL: | Means the continuation of a business license from the previous year. |
REVOCATION (OF ANY BUSINESS LICENSE): | Means withdrawal of the City's authorization to operate a business in the City. |
SHORT TERM LICENSE: | Means a license for a business activity lasting seven (7) days or fewer unless the license is a seven (7) day contractor license. (Ord. 698, 8-5-2020, eff. 8-31-2020) |
