The commission shall have the powers and duties which are assigned to it by charter, ordinances or resolutions of the city and general laws of the state. The duties of the commission shall include the following: (1996 Code § 2.04.080)
A. Comprehensive Development Plan: The commission shall:
1. Proceed with the preparation of a comprehensive development plan for the city with due and deliberate consideration of the goals and guidelines of the land conservation and development commission of the state of Oregon. Upon completion, recommend the plan to the city council for adoption.
2. Subsequent to its adoption, base all its decisions relating to land use, public facilities, circulation, community appearance, and similar matters on the plan, and ensure that all matters affecting the development of the city and its environs including, but not limited to, zoning, subdivisions, signs and capital improvements shall conform to the plan.
3. Recommend to the city council ordinances (and amendments to existing ordinances) intended to carry out the purposes, principles and proposals expressed in the comprehensive development plan (such as zoning, subdivision and the like).
4. Review ordinances in existence at the time of adoption of the comprehensive development plan to ensure that they are not inconsistent with the plan. (1996 Code § 2.04.080; amd. 2004 Code)
B. Subdivisions: The commission shall review and, subject to appeal, take final action on proposed subdivisions and major or minor land partitionings.
C. Zoning: The commission shall review and, subject to appeal, take final action on proposed variances, conditional uses or other deviations from the city zoning ordinance as it now exists or is constituted in the future.
D. Studies: The commission shall conduct studies appropriate to an understanding of area development and its significance to the public interest.
E. Capital Improvement Program: The commission shall prepare and periodically review the city's capital improvement program, ensure that it is consistent with the comprehensive development plan, and make recommendations as appropriate to the common council.
F. Consult With Public Agencies: The commission shall consult and advise with public agencies and private citizens on matters concerning the area within six (6) miles of the city limits and the city's urban growth boundary.
G. Other Functions: The commission shall perform such other functions as the city council may request.
H. Promotion Of Public Interest, Health, Safety: The commission shall study and propose in general such measures as may be advisable for promotion of the public interest, health, morals, safety, comfort, convenience and welfare of the city and its environs. (1996 Code § 2.04.080)
