8-5-4: CUSTOMER RESPONSIBILITY:
   A.   Infectious Or Hazardous Waste; Damage To Containers:
      1.   No person shall place infectious or hazardous waste for collection or disposal by the city or the city's franchisee, hereinafter referred to as the "collector". Special arrangements shall be made by the customer with the collector for the collection of infectious waste.
      2.   No person shall place or cause to be placed any hazardous materials, and materials such as chemicals, paint, corrosive materials, infectious waste, and hot ashes in a can, cart, container, or drop box. When such materials or customer abuse, fire, or vandalism cause excessive wear or damage to a cart, container or drop box, the costs of repair or replacement may be charged to the customer.
   B.   Use Of Containers Restricted: No person shall place material in or remove material from a solid waste collection container without permission of the owner of the container.
   C.   Removal Of Solid Waste Placed For Collection: No person shall remove solid waste placed out for collection and resource recovery by the collector or a person exempted by this chapter and operating solely within the exemption.
   D.   Solid Waste Below Ground: No person shall leave solid waste to be collected below ground.
   E.   Can Or Cart Placement Restricted: No person shall locate a can or cart for residential service behind any locked or latched door, gate or inside any building or structure.
   F.   Safe Access To Containers: No person shall provide other than a safe access to the solid waste container or wastes. The collector may charge a reasonable extra fee for return service to such container or wastes. No person shall permanently locate such container or wastes on or in any public right of way without written authorization of the city.
   G.   Containers For Mechanical Pick Up: No person shall cause a container designed for mechanical pick up to exceed safe loading weights or volumes as established by the collector to protect service workers, the customer, the public and the collection equipment.
   H.   Containers For Manual Pick Up: No person shall provide a container designed for manual pick up that exceeds thirty two (32) gallons in size or sixty (60) pounds in loaded weight. Such containers shall be made of metal or be rigid, fireproof, rodentproof, and not subject to cracking or splitting, and shall have proper handholds or bales.
   I.   Bundled Solid Waste: Unless special service or service equipment is provided by the collector for handling unconfined waste, no person shall leave for manual pick up and collection materials such as rubbish and refuse, brush, leaves, tree cuttings and other debris, except in securely tied bundles or in a box, sack or other receptacle. Solid waste so bundled, tied, or contained shall not exceed sixty (60) pounds in weight.
   J.   Contract For Special Service: No person requiring an unusual volume of service or a special type of service requiring substantial investment in equipment shall refuse to enter into a contract with the customer as necessary to finance and assure amortization of such equipment. The purpose of this provision is to assure that such equipment not become a charge against other customers who are not benefitted.
   K.   Overfilling Containers: No person shall overfill a can, cart or container so that the lid cannot be securely closed. If a can, cart or container is overfilled, an additional reasonable fee may be charged. If the contents of a container, cart or drop box are compacted (either mechanically or manually), the compactor rate shall be charged.
   L.   Stationary Compacting Devices: No person shall utilize stationary compacting devices for solid wastes, except those that comply with federal, state, and city safety standards and provide adequate protection to the user.
   M.   Transporting Solid Waste; Dropping Load: No person shall use any vehicle to transport solid waste unless it is so loaded and operated as to prevent the wastes from dropping, shifting, leaking, blowing, or otherwise escaping from the vehicle onto the public right of way or adjacent lands.
   N.   Maintenance Of Containers; Accumulations Of Waste Prohibited: No person shall fail to maintain and clean cans, and containers provided by that person. No such person shall allow the accumulation of wastes in the area around such cans and containers shall be kept free from accumulated wastes. The collector shall provide maintenance to containers supplied by the collector. (1996 Code § 13.50.040)
