The City may furnish water to properties outside the Clatskanie City limits, charging rates fixed by the Council in the manner provided in Chapter Four of this title (Section 8-4-1 through Section 8-4-3). Providing water service to property outside the City is by agreement. Water service outside the City shall at all times be subject to the prior and superior rights of consumers inside the City.
A. Before a new water service is provided outside of City limits, the owner of the property to be served shall sign a water service agreement accepting the conditions of City water service and covenanting that whenever the served property is or becomes contiguous to the City, the owner will consent to annexation of the property. The water agreement will be in the form of a contract and recorded in a manner that is binding on all successors with an interest in that property.
B. Direct water service to a property owner outside the City requires a meter of approved size and design which shall include a backflow prevention assembly located as required by the City. This provision is a condition precedent to water service from the City.
C. The City may temporarily suspend water delivery for the purpose of making repairs or improvements to its system.
D. Water delivery outside City limits is subject to all applicable provisions of City Code and City of Clatskanie Policy. The City may make service subject to any other reasonable conditions the City deems appropriate or proper. (1996 Code § 13.08.030; amd. Ord. 700, 3-3-2021)
