7-2-8: REPAIRING SIDEWALKS:
   A.   Duty To Repair:
      1.   All sidewalks in the city upon any street or alley or which are otherwise open to the general public shall be kept in good and substantial repair, and it shall be the duty of the owner and occupant of any premises abutting upon the sidewalk to make such repairs and keep the same in repair.
      2.   It is unlawful for the owner and occupant of any premises to allow any sidewalk upon or in front of the premises to be or remain out of repair, or to be or remain out of good and substantial condition. (1996 Code § 12.04.240)
   B.   Failure To Repair; Nuisance: Any sidewalk in the city upon any street or alley or which is otherwise open to the general public which is not kept in good and substantial repair shall constitute a public nuisance. The owner and occupant of the premises abutting any sidewalk which is determined to constitute a public nuisance shall be subject to the penalty provision and abatement procedures under title 4, chapter 1 of this code. The city shall be allowed to proceed against the owner or occupant of the premises abutting any sidewalk which is determined to constitute a public nuisance, without any necessity of naming both owner and occupant.
