9-1-3: BUILDING PERMIT REQUIRED:
   A.   Application And Plans: A building permit shall be secured from the Town Clerk on written application accompanied by plans and specifications, in duplicate, which must state the specific nature of the construction or alterations to be made. The plan must be verified by the person who will perform or be in charge of the construction or alteration.
      1.   Uninhabited Properties: Professional surveys are required to be conducted on all uninhabited properties prior to building permit approval.
   B.   Variations From Plan Prohibited: No material variation from the approved plan shall be allowed unless such variations shall first have been approved in writing by the building inspector.
   C.   Approval Of Plan: The application and plans shall be forwarded from the Town Clerk to the building inspector, who shall review the plan to determine whether the proposed construction or alteration conforms to the Building Codes and ordinances of the Town. The building inspector shall return the plans to the Town Clerk within ten (10) days with the statement "approved" if the plans do conform or "disapproved" if the plans do not conform. If the plans are disapproved, the reasons therefor shall be annexed to the plans. On receipt of an approved plan, the Town Clerk shall issue a permit to the applicant, together with one set of the approved plan. One set of the plans shall be retained by the building inspector. The building inspector may revoke at any time a permit which has been issued for any building constructed or being constructed or which would be or result, if constructed, in violation of any ordinance of the Town.
   D.   Agricultural Structures:
      1.   As used in this subsection, the term "agricultural building" means a structure which is used solely for agriculture purposes, and not for human occupancy, including structures such as, but is not limited to, pole barns, stables, crop protection shelters, shade shelters, storage structures for equipment and machinery used exclusively in agriculture.
      2.   Upon the written request of the applicant for a building permit for an agricultural building, and upon the applicant's acknowledgment of the applicant's responsibilities under subsection D3 of this section, the building inspector may waive the requirement for construction documents from a design professional in accordance with Utah State Code. In doing so, the building inspector shall be relieved of any personal liability as provided in Utah State Code.
      3.   Any applicant who requests a waiver under subsection D2 of this section assumes all risks associated therewith and agrees to defend, indemnify, and hold Clarkston Town and any of its officials, officers, agents, employees, and contractors, including the building inspector, harmless from and against any and all losses, claims, damages, liabilities and obligations of any kind and description, including any reasonable attorney fees, which arise out of the agricultural building that is the subject of the application or any matters related thereto.
      4.   It shall be unlawful to use any agricultural building for human occupancy. Any change of use of an agricultural building requires the issuance of a certificate of occupancy for the new use in accordance with the provisions of the State Construction Code and this Code.
