8-1-27: WINTER WATER RUNNING:
   A.   As used in this section, the term "winter water months" means the three (3) month period between December 1 through February 28 of each year.
   B.   Notwithstanding sections 8-1-11 and 8-1-18 of this chapter, during the winter water months users of water from the municipal water system may continuously run water, without overage charges being applied, only so far as needed to prevent or reduce the likelihood of the freezing of pipes, connections, or other apparatus of the municipal water system, provided that such continuous running of water does not: threaten the health and safety of any person or animal, damage or create the potential for damage to any real or personal property, create a nuisance under title 4, chapter 2 of this code, or violate any other state or federal law, rule or regulation.
   C.   The governing body may fix, suspend, or alter the rates for water use during the winter water months in accordance with the provisions of section 8-1-2 of this chapter.
   D.   The governing body may fix, suspend, or alter from time to time by resolution any limits on the number of gallons of water that may be used for continuous running of water under this section. (Ord. 17-04, 2-21-2017)
