(A) (1) An ATV/UTV may be operated on any street, road, or alley, within the village, except for a controlled-access highway, when such operation occurs only between one-half hour after sunrise and one-half hour before sunset.
(2) Any person operating an ATV/UTV shall have a valid Class O operator’s license or a farm permit as provided in Neb. RS 60-4,126, shall have liability insurance coverage for the all-terrain vehicle while operating the all terrain vehicle on a highway, street, road, or alley, and shall not operate such vehicle at a speed in excess of the posted speed limit. The person operating the ATV/UTV shall provide proof of such insurance coverage to any peace officer requesting such proof within five days of such a request.
(3) When operating an ATV/UTV, the headlight and taillight of the vehicle shall be on and the vehicle shall be equipped with a bicycle safety flag which extends not less than five feet above the ground attached to the rear of such vehicle.
(4) The bicycle safety flag shall be triangular in shape with an area of not less than 30 square inches and shall be dayglow in color.
(B) ATV/UTV may be operated without complying with division (A) above in parades which have been authorized by the state or any department, board, commission, or political subdivision of the state.
(C) Subject to division (A) above, the crossing of a controlled-access highway shall be permitted by an ATV/UTV only if:
(1) The crossing is made at an angle of approximately 90 degrees to the direction of the highway and at a place where no obstruction prevents a quick and safe crossing;
(2) The vehicle is brought to a complete stop before crossing the shoulder or roadway of the highway; and
(3) The operator yields the right-of-way to all oncoming traffic that constitutes an immediate potential hazard.
