The Drainage Board shall proceed with enforcement action under the authority of this chapter or by a referral from the SWCD.
(A) The Drainage Board shall post a stop-work order if:
(1) Any land disturbing activity regulated under this chapter is being undertaken without a permit;
(2) The erosion and sediment control plan is not being implemented in good faith; and/or
(3) The conditions of the permit are not being met.
(B) If, within 30 days after issuance of a stop-work order, a permit holder does not comply with the erosion and sediment control plan or permit conditions, the Drainage Board may revoke the permit.
(C) Upon appeal to the Drainage Board, a stop-work order or the revocation may be retracted.
(D) Ten days after revoking the permit, the Drainage Board may issue a notice of intent to the violator stating that 14 days after issuing the notice of intent the Drainage Board will use the surety bond to perform work necessary to provide compliance with this chapter.
(E) Compliance with the provisions of this chapter also may be enforced by injunction.
