(A) Any citation issued hereunder may be civilly prosecuted in any circuit, superior or county court in the county. All local rules of practice heretofore promulgated in said courts shall apply to the enforcement of this chapter. All state rules of trial procedure shall, subject to the determination of the presiding judge, apply to such enforcement procedures.
(B) All enforcement actions shall be prosecuted by an attorney designated and selected by the Board to represent the county’s interest in such civil prosecution.
(C) The Board shall be required to prove a violation of this chapter by a preponderance of evidence, as determined by the presiding judge, before becoming entitled to entry of judgment in the Board’s favor.
