(A) The Board of Commissioners of the county now declares it is its policy to protect the property, interests and rights of landowners whose homes and/or property are located along the route of access to the Clark-Floyd landfill site near Bennettsvelle, Indiana.
(B) All commercial and non-commercial, and any other, users of the Clark-Floyd landfill site, located near Bennettsville, Indiana on Wilson Switch Road, shall be, and now hereby are, required to cover the loads they intend to present and dump at said landfill site by secured tarpaulin or other secured means during transport to said site.
(C) The Board of Commissioners shall hire an agent/employee to perform regular work responsibilities at the access gate/entrance to said landfill site which responsibilities shall include, but not be limited to, inspection of any and all loads presented for dumping and/or disposal at said site to determine whether or not said loads are covered by secured tarpaulin or other secured means.
(D) Said agent/employee of the Board of Commissioners shall refuse to allow access into said landfill site to any commercial, non-commercial or other potential user who wishes to present or dump a load of solid waste at said site who does not comply with the terms of this section by transporting said load in the secured covered fashion set forth herein above.
(E) Further additional duties of said agent/employee of the Board of Commissioners of the county shall be determined and established by the Board of Commissioners at a later date.
(F) All loads required to be covered by tarpaulin or “tarped” pursuant to the terms of this section shall be so covered or “tarped” at the time of origin prior to arrival at the landfill entrance. Any load not so covered, on the landfill approach roads or at the landfill entrance, shall be ordered turned around and refused access to the Clark-Floyd landfill.
(G) The contractor that is retained by the Board of Commissioners of the county for services in the nature of policing, picking up and removing refuse on the landfill access roads, and whose contract includes picking up and transporting any spill, dumped or otherwise disposed of litter or solid waste from the access road into the landfill shall not be subject to the covering or “tarping” requirements of this section.
