§ 34.048  ADULT FACILITIES USAGE FUND.
   (A)   Every recital in the ordinance codified herein  is adopted into this section.
   (B)   There is hereby established the Clark County Adult Facilities Usage Fund.
   (C)   This Fund shall be non-reverting in nature. All financial and other record-keeping services shall be performed, with respect to this fund, by the Auditor.
   (D)   All monies received from external government agencies (state, local, federal or other) for rental of space in the adult jail, to the extent not required by law to be transmitted to a local community corrections agency, shall be collected in the fund created by this section and expenditures from said fund shall only be for the purposes and by the means authorized below. This Fund may be expended, only upon claim approved by the Board in writing, without the necessity of further appropriation for the following purposes:
      (1)   Emergency repairs to the physical plant of the Adult Corrections Facilities when the County General Fund is not capable of paying for such repairs;
      (2)   Repairs, maintenance and oversight of the physical plant or grounds at any county building, structure or agency/department location, as determined by the Board;
      (3)   Purchase of equipment and/or tools that are necessary for the operation and maintenance of the Adult Corrections Facilities or other county building, structure or grounds where a county agency/department is located;
      (4)   For emergency repairs, on short notice that are necessary to the structures, equipment or facilities of the Adult Corrections Facilities;
      (5)   For equipment, furniture and fixtures that are determined to be necessary by the Sheriff for the operation of the Adult Corrections Facilities, and approved by the Board, as may be approved by this Board;
      (6)   For any other agreed expenditure of these funds that are verified to the Board in writing by the county fiscal body (for the spending purposes outlined above) when it is demonstrated by the fiscal body, in writing, that it has insufficient General Fund resources or appropriation available to meet a physical plant, furniture, equipment or tooling need of the Adult Corrections Facilities; and
      (7)   For any other public expenditure deemed necessary to the public interest by the Board.
