(A) There is hereby established an Infraction User Fee Fund for the benefit of the Office of the County Prosecuting Attorney.
(B) The Infraction User Fee Fund shall consist of receipts, deposits and collections received from the Clark Superior Court #3, the Jeffersonville City Court, and the Clarksville Town Court, in relation to infraction deferral and driver improvement programs.
(C) The Infraction User Fee Fund shall be non-reverting in nature and disbursements therefrom shall be pursuant to a claim submitted to, and approved by, the Board of Commissioners, to supplement the budget of the Office of the County Prosecuting Attorney, in such sums as are reasonably requested by the Prosecuting Attorney, and as are approved by the Board from time to time.
(D) Monies and funds in the Infraction User Fee Fund shall be appropriated for expenditure by the County Council to the extent required by state law.
