(A) Every recital in the ordinance codified herein is adopted into this section.
(B) There is hereby established the Clark County Indiana Long Range Economic Development, Infrastructure and County Road Development and Maintenance Fund.
(C) Said fund shall be non-reverting in nature, and shall be funded by the following components of the Clark-Floyd Landfill tonnage fee, as adjusted from time to time: those monies designated by the Board of Commissioners and the Board of Commissioners of Floyd County, Indiana, in proportions determined by both respective Boards, to be divided from the County Wilson Switch Road Basic Maintenance Fund (Ordinance 8-1993 of the county; Fund #270) pursuant to the pre-existing agreement between both Boards; and those monies designated by the Board of Commissioners from time to time, to be deposited in this fund from any other solid waste fund source under their control. The first installment of monies into this fund is ordered to occur by virtue of a 3-0 vote of the Board of Commissioners on February 16, 1994 to issue a warrant in the sum of $137,803.64 from Fund 270 into the fund established hereby and to issue a warrant in the sum of $99,788.84 from Fund 270 to the Floyd County Landowners Liability and Contingency Fund and to issue this latter warrant in care of the Auditor of Floyd County.
(D) Expenditures from said fund may be made for the following purposes:
(1) For expenses in relation to any economic development project, including projects pertaining to the planning and development of infrastructure, in unincorporated county as determined and approved by the Board of Commissioners;
(2) For expenses in relation to construction, maintenance and planning of road and infrastructure improvements, repair and maintenance in unincorporated county as determined and approved by the Board of Commissioners, including expenses in relation to the construction, maintenance and repairs of bridges in unincorporated county;
(3) For expenses in relation to any long range economic development planning project or venture, as determined and approved by the Board of Commissioners;
(4) For expenses in relation to the repair, maintenance and care of all pre-existing roads and bridges in the and care of all pre-existing roads and bridges in the county road system, as determined and approved by the Board of Commissioners; and
(5) For expenses in relation to any other county-wide service or project administered, in whole or in part, by the Board of Commissioners as a service to the citizens and public interests of the county, as determined and approved by the Board of Commissioners.
(E) The Auditor is hereby directed to maintain and manage accurate accounting information concerning the receipts, expenditures and balances of this fund, to list it under the designation of Landfill Funds, along with already existing county funds not funded by direct property tax revenues on all financial reports and computer printouts made and generated for, and in the name of, the Board of Commissioners.
(F) No county warrants shall be authorized to issue for expenditures from this fund for payment of any monies except upon a verified itemized claim for same being submitted, reviewed and approved by the Board of Commissioners and without the Commissioners’ ordering the issuance of such a warrant. No expenditures from this fund shall be made except in accord with this section.
