A. Late Penalty: A late penalty as set forth in schedule S9 of this Code shall be assessed against each bill that is not paid when due.
B. Delinquency And Termination Of Service: In the event the charge for water service is not paid within twenty (20) days after the billing date, it will be considered past due and the late penalty (subsection A of this section) will apply. Accounts which remain past due thirty (30) days will receive a final notice posted to property prior to termination of water service. Additionally the owner shall be liable to pay a "red tag" posting fee for the notice as set forth in schedule S9 of this Code after the notice is posted. This notice shall notify the owner of all charges due on the water account to prevent termination of water service. If payment is not received within two (2) business days after the customer's property is noticed service may be terminated, and the owner shall be required to pay a service reinstatement fee set forth in schedule S9 of this Code for termination of services in addition to payment of all delinquent charges. The owner of the premises shall be liable to pay all charges due for the service in the event the user is a tenant or occupant.
C. No Service To Delinquent Customers: No current or previous property owner owing water charges to the Village, who moves to other premises where there is a Village water connection, or where such connection shall afterwards be made, shall be supplied with water service until all charges are satisfied. Should service for any customer be terminated for nonpayment of bills, service shall not thereafter be supplied until all delinquent charges, including termination charges and late penalties, are satisfied.
D. Lien For Charges: In the event that water charges are not paid according to subsection B of this section, a lien shall be placed upon the real estate to which the service was supplied. The Village shall file a sworn statement showing delinquency in the Office of the Recorder of Deeds of DuPage County, in the manner provided by State Statute.
E. Disputed Bills: If an owner, tenant or occupant desires to dispute all or any part of the water bill, the customer shall nevertheless pay the full amount of the bill when due and include with payment written notification to the Village that the charges are disputed, the grounds for dispute and the amount in dispute. Upon receipt of notification of dispute, the Village Manager or his/her designee shall meet with the customer to resolve such dispute. No adjustment or relief on account of any disputed charges shall be made unless disputed charges are the subject of such notice within thirty (30) days from the time the customer knew or should have known of the facts giving rise to the dispute.
