A. Permit Required: No sidewalk shall hereafter be laid in any public way unless a permit shall first have been obtained from the village manager or his designee, and then its construction and its dimensions shall, in every particular, comply with the specifications for construction provided, and the terms and conditions of the permit granted.
B. Specifications: Sidewalks shall be of concrete not less than five inches (5") thick and shall be constructed in accordance with specifications determined by the village engineer. Subgrade shall be constructed true to grade and tamped or rolled where necessary. Expansion joints will be provided where required. Surfaces shall be divided one-fourth inch (1/4") deep and no slab shall be more than six feet (6') nor less than four feet (4') long. Surplus or waste material shall be disposed of by the contractor at the contractor's own expense. (Ord. 90-03-03)
C. Mandatory Installation: A holder of a building permit that would allow a new principal structure or a "substantial addition" to a principal structure, which is defined as an addition that increases the floor area by an amount which is more than one hundred percent (100%) of the existing floor area of the structure, including single-family residences, shall install a sidewalk along the entire front or corner side yard of the lot, including an extension of the sidewalk to the edge of the street pavement for corner lots, if no sidewalk currently exists.
(1) If the construction of the sidewalk required by the above provision would result in a total length of sidewalks along the street within the respective block that is less than fifteen percent (15%) of the total length of the block, the holder of the building permit shall have the option to pay a fee in lieu of installing the required sidewalk. The fee due shall be calculated by multiplying the number of square feet within the required sidewalk by one hundred ten percent (110%) of the per square foot cost of sidewalk construction in the village's last awarded contract which included sidewalk construction. The fees collected pursuant to this subsection shall be deposited into the village's sidewalk fund, and shall be used to construct sidewalks along the block in question at such time as the village moves forward with a sidewalk construction project in relation to said block.
(2) If a sidewalk exists, but is damaged during any type of construction, the holder of the building permit for the construction project shall replace said sidewalk.
(3) All new and replacement sidewalks shall be installed according to the specifications set forth by the village engineer. (Ord. 09-08-24)
