A. Definitions: As used in this section, the following words and terms shall have the meanings ascribed to them in this subsection:
EMPLOYEE: Includes any person who is or was an officer or member of a board, commission or committee, servant or employee, agent of the village who was serving as such at the request of the village, whether or not compensated, and in event of the death of such employee, his/her estate shall be considered an employee for the purpose of this chapter, but not including an independent contractor.
INDEMNIFICATION: Payment on behalf of the employee to the full extent permitted by the Illinois Local Governmental and Governmental Employees Tort Immunity Act1, to compensate for judgment against the employee, or for compromise or settlement of such a claim or action against said employee, and payment to said employee for court costs and attorney fees incurred by virtue of said claim or action; however, in accord with the Act no indemnification shall be made for any part of punitive or exemplary damages.
INJURY: Includes physical, emotional, or character damage to a person, or property damage.
B. Indemnification Of Employees: Each and every employee of the Village shall be indemnified by the Village against any and all claims and liabilities to which he has or shall become subject by reason of an injury allegedly arising out of an act or omission occurring within the scope of his/her employment as such employee, except any claim or liability arising out of reckless or wilful misconduct.
C. Defense By Village: The Village may appear and defend against the claim or action.
D. Right Nonexclusive: The right of indemnification hereinabove provided for shall not be exclusive of any rights to which any employee of the Village may otherwise be entitled to by Illinois or Federal law. (Ord. 15-04-27)
