48.6: CONDUCT OF RAFFLES:
The conducting of raffles within the village is subject to the following conditions and restrictions:
   A.   Disposition Of Proceeds: The entire net proceeds of any raffle must be exclusively devoted to the lawful purpose of the organization permitted to conduct that game;
   B.   Management: No person except a bona fide director, officer, employee or member of the sponsoring organization may manage or participate in the management of the raffle;
   C.   Remuneration: No person may receive any remuneration or profit for managing or participating in the management of the raffle;
   D.   Licensee Name On Tickets: The name and address of the sponsoring licensee organization shall be included on all raffle chances, tickets and the like sold by said licensee organizations; (1992 Code; amd. Ord. 97-09-22)
   E.   Chances: Raffle chances may be sold throughout the State of Illinois, including beyond the borders of the Village; however, winning chances may be determined only at those locations specified on the license for the raffle;
   F.   General Public: All drawings for the winning raffle ticket or tickets shall be held in a place open to the general public; (1992 Code)
   G.   Minors: A person under the age of eighteen (18) years may participate in the conducting of raffles or chances only with the permission of a parent or guardian. A person under the age of eighteen (18) years may be within the area where winning chances are being determined only when accompanied by his or her parent or guardian; (Ord. 97-09-22)
   H.   Rental Of Premises: A licensee may rent a premises on which to determine the winning chance or chances in a raffle, provided that the rent is not determined as a percentage of receipts or profits from the raffle;
   I.   Liability: If a lessor rents premises where a winning chance or chances on a raffle are determined, the lessor shall not be criminally liable if the person or organization who uses the premises for the determining of winning chances does not hold a license issued under the provisions of this chapter.
   J.   Use of Third Parties. Notwithstanding subsections B. and C. above, sponsoring organizations may contract with third parties who, acting at the direction of and under the supervision of the sponsoring organization, provide bona fide services to the sponsoring organization in connection with the operation of a raffle and may pay reasonable compensation for such services.  Such services include the following: (i) advertising, marketing and promotion; (ii) legal; (iii) procurement of goods, prizes, wares and merchandise for the purpose of operating the raffle; (iv) rent, if the premises upon which the raffle will be held is rented; (v) accounting, auditing and bookkeeping; (vi) website hosting; (vii) mailing and delivery; (viii) banking and payment processing; and (ix) other services relating to the operation of the raffle.
