SG41.1: TRAFFIC FINES:
   A.   Speeding: The village consists of curving, winding, hilly streets with few exceptions. Almost all roads are without curbs and have unmarked pavement edges. Parking along the shoulder is primarily unrestricted further magnifying the recklessness of speeding on village streets. The village qualifies as an urban area under the Illinois motor vehicle code and has lowered the standard speed limit from thirty (30) miles per hour to twenty five (25) miles per hour. Because of the hazardous conditions aforedescribed, the village finds that recklessness intensifies in concert with increasing speed, and that a corresponding minimum penalty, escalating in concert with increased speed, shall be levied as follows: (1992 Code)

Fines shall not be more than seven hundred fifty dollars ($750.00), exclusive of court costs and fees. (Ord. 06-07-27)
   B.   Parking: Fines for parking violations shall not be less than twenty five dollars ($25.00) and not more than five hundred dollars ($500.00), unless otherwise required by the Illinois vehicle code, 625 Illinois Compiled Statutes 5/1-100 et seq.
      (1)   Settlement: Settlement for violations of chapter 41 of this code shall be in accordance with the procedures set forth in chapter 45.1 of this code with the following additions:
         (a)   A notice of impending driver's license suspension shall be sent to the person liable for any fine or penalty that remains due and owing for ten (10) or more violations of the village of Clarendon Hills' standing, parking or compliance regulations pursuant to this section. The notice of impending driver's license suspension shall state the following information:
         (b)   The failure to pay the fine owing within forty five (45) days of the notice's date will result in the village notifying the secretary of state that the person is eligible for suspension under 625 Illinois Compiled Statutes 5/6-306.5 of the Illinois vehicle code;
         (c)   The notice of impending driver's license suspension shall be sent by first class mail, postage prepaid, to the address recorded with the secretary of state or, if any notice to that address is returned as undeliverable, to the last known address recorded in a United States post office approved database.
      (2)   Driver's License Suspension:
         (a)   The traffic compliance administrator in the village of Clarendon Hills police department, by certified report, may request that the secretary of state suspend the driving privileges of an owner of a registered vehicle who has failed to pay any fine or penalty due and owing as a result of ten (10) or more violations of the village of Clarendon Hills' standing, parking or compliance regulations. The report shall be certified and contain the following:
         (b)   The name, last known address as recorded by the secretary of state, as provided by the lessor of the cited vehicle at the time of lease, or as recorded in a United States post office approved database if any notice sent under this section is returned as undeliverable, and driver's license number of the person who failed to pay the fine or penalty and the registration number of any vehicle known to be registered to such person in this state;
         (c)   The name of the municipality making the report pursuant to this section; and
         (d)   A statement that a notice of impending driver's license suspension has been sent to the person named in the report at the address recorded with the secretary of state or at the last address known to the lessor of the cited vehicle at the time of the lease or, if any notice sent under this section is returned as undeliverable at the last known address recorded at a United States post office approved database; the date on which such notice was sent; and address to which such notice was sent.
         (e)   The traffic compliance administrator shall notify the secretary of state whenever a person named in the certified report has paid the previously recorded fine or penalty or whenever the municipality determines that the original report was in error. A certified copy of such notification shall also be given upon request and at no additional charge to the person named therein.
   C.   All Others: For all other traffic violations, except overweight violations which shall be controlled by the applicable fine schedule as adopted pursuant to subsection 41.45A of this code, the fine shall not be less than seventy five dollars ($75.00) and not more than seven hundred fifty dollars ($750.00), exclusive of court costs and fees.
   D.   Motor Vehicle Licenses: All fines for violations of chapter 43 of this code shall be not less than twenty five dollars ($25.00) and settled in accordance with the procedures set forth in section 45.1 of this code. (Ord. 09-12-38)
