32.3: PERFORMANCE REQUIREMENTS:
   A.   Provision Of Service: All waste disposal services shall be provided only by scavengers licensed by the Village and only to eligible service subscribers or account holders within the Village. Such services shall be in accordance with the terms and provisions listed herein and any terms and conditions of the licensing agreement. For the purposes of this Chapter, the term "subscriber/account holder" is defined as any person, firm, business, corporation or other entity that establishes a relationship for services, in accordance with the applicable rules and regulations, with a scavenger licensed by the Village. Every licensee shall fully comply with all Federal, State and local laws, regulations, ordinances, resolutions, decrees, orders or rulings which in any way pertain to licensee, its property, its employees or any of its activities. Failure to comply shall constitute a violation of this Chapter.
   B.   Dumping Garbage Prohibited: The garbage and other offensive matters described in Section 32.1 of this Chapter shall under no circumstances be disposed of in any public place within the Village, nor in any other manner or place than as prescribed by the Village Manager. The application for license shall state the applicant's proposed method and location of disposal, and is subject to approval by the Village Manager.
   C.   Hours Of Operation: Residential and commercial service shall be between the hours of six o'clock (6:00) A.M. and six o'clock (6:00) P.M. Service shall not be provided on Sundays, except for emergency or other special purposes, when authorized by the Village Manager.
   D.   Operation Of Scavenger Vehicles:
      (1)   Parking: It shall be unlawful for any scavenger vehicle or vehicles to park before any building, place of business or other premises for an unreasonable length of time in loading.
      (2)   Overnight Storage Of Vehicles: No scavenger vehicles shall be stored overnight within the corporate limits of the Village.
      (3)   Sanitation: All scavenger vehicles shall be cleaned and disinfected when not in use in order that these vehicles do not become offensive. Any laxity on the part of the driver or owner of the scavenger vehicle in keeping such vehicles clean and inoffensive shall be considered a violation of this Chapter.
      (4)   Enclosed And Watertight: Any vehicles used by a scavenger service shall be completely enclosed and watertight.
   E.   Revocation: Subject to the terms and conditions of the licenses issued, the license agreements entered into in accordance with this Chapter, and all applicable laws, the Village shall have the right to alter, suspend, or revoke any scavenger license issued pursuant to this Chapter for reasons which shall include, but not be limited to, inadequate service, insufficient finance responsibility, failure to pay required fees, or violation of any Federal, State or local laws, ordinances, regulations, resolutions, decrees, orders or rulings which in any way apply to licensee or the service it provides.
