A. All reports and decisions of the director made pursuant to this chapter shall be made timely and in writing. Any decision of the director regarding chapters 21 through 26 of this code and this chapter may be appealed to the board of trustees, acting as the building board of appeals. Any decision of the director regarding chapter 20 of this code may be appealed to the zoning board of appeals/plan commission and may include a request for a variation pursuant to chapter 20, article 16 of this code.
B. Appeals shall be heard in a timely manner. Appeals must be made in writing and filed with the village manager within ten (10) business days of the issuance of the memorandum of the action appealed. The burden of proof shall be on the appellant. No decision of the director shall be reversed or modified unless the designated board finds that the director's action or interpretation of this code was clearly erroneous. The board hearing the appeal shall timely report its decision in writing to the village manager. The decision of the board shall be final and binding.
C. All reports and decisions of the director and decisions of any board made pursuant to this chapter shall be sent immediately to the applicant/appellant by mail or, if an address within the village is provided, also by delivery. (Ord. 06-11-38)
