(A) No person within this city shall consume alcoholic beverages while such person is upon any public street, alley, or other public highway or in any public building or other place except as provided in division (C) of this section or on the premises of a licensee of the ABLE Commission who is authorized to sell or serve spirits by the individual drink. No person shall be intoxicated in a public place within this city.
(B) No person within this city shall drink or possess alcoholic beverages in any building or on any property owned by the City of Claremore, except as provided in division (C) of this section.
(C) (1) The prohibition in divisions (A) and (B) of this section shall not act to prohibit:
(2) A person of lawful age possessing or consuming alcoholic beverages on the premises of a place licensed by the ABLE Commission to sell alcoholic beverages for consumption on the premises and at the following locations:
(a) In downtown between 8:00 a.m. and 2:00 a.m. The term DOWNTOWN is hereby defined as the area between the north side of 4th Street and the south side of Patti Page Boulevard and the west side of the Union Pacific Railroad line and west side of Lynn Riggs Boulevard;
(b) At an event held on the Claremore Expo Grounds. The term CLAREMORE EXPO GROUNDS is hereby defined as all area owned by the city in and around the Claremore Expo Center, including, but not limited to buildings, sidewalks, parking lots and open grass spaces. The term CLAREMORE EXPO GROUNDS does not include the Claremore Recreation Center area located south of Expo Road and west of Veterans Parkway;
(c) At an event at the Claremore Regional Airport, Stampede Park, G. Waide Sibley Gazebo Park, or the Claremore Museum of History authorized by the City Manager or his/her designee to sell and/or serve alcoholic beverages;
(d) At an event authorized by the City Council to sell and/or serve alcoholic beverages; or
(e) At parklets placed within the public right-of-way in the downtown area.
