§ 50.16 UNAUTHORIZED USE OF ELECTRICITY.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   CONSUMER. The person in whose name electric service was applied for and approved.
   UNAUTHORIZED USE OF ELECTRICITY. Any use of the city’s electric service through a meter which has been tampered with or interfered with for the purpose of adjustment, fraudulent or otherwise.
   (B)   In the event unauthorized use of electricity is discovered, or where the city’s regulating or measuring equipment or other property has been tampered with, electric service may be discontinued by the city without advance notice to the consumer.
   (C)   Where electric service to a consumer has been discontinued by the city based upon unauthorized use of electricity or tampering with the city’s regulating or measuring equipment, such service to the consumer will not be resumed until such consumer shall have paid following:
      (1)   The charge for the unauthorized use of electricity, which shall be based upon past usage;
      (2)   The cost of replacement and/or repair of any damaged meter or associated equipment;
      (3)   The cost of installation of protective facilities, or of relocation of the meter, if determined necessary by the city;
      (4)   A reconnect charge which shall be based on the number of previous instances of tampering by the same consumer(s) in accordance with the following table:

      (5)   An additional deposit, which shall be in addition to any deposit or deposits which have previously been paid. The amount of the additional deposit shall be based on the number of previous instances of tampering by the same consumers in accordance with the following table:

   (D)   Use of electrical service from an electrical service installation or meter which has been tampered with is hereby declared to be a misdemeanor.
