§ 33.36 INITIAL CODE APPEAL.
   (A)   An applicant or permit holder may appeal the decision of the Fire Marshal or persons enforcing the Fire Code of the City of Claremore to the Fire Code Official. The written appeal shall include sufficient information to allow the Fire Code Official to adequately and review and interpret the specific situation and conditions present and the specific references in the Fire Code. The Fire Code Official shall render a decision on the appeal in writing within 10 business days.
   (B)   If the applicant or permit holder is not satisfied with the decision of the Fire Code Official, the person appealing shall make a written request within five business days to the City Manager requesting that the Board of Appeals referenced in the Fire Prevention Code of the City of Claremore be formed. If not set by other ordinances or resolutions, the City Manager will provide an estimated cost and time frame to hold a hearing of the Board of Appeals to the person making such an appeal within ten business days.
   (C)   Court review. Any person aggrieved by a decision of the board of appeals, or any officer or official board of the jurisdiction, may appeal to the appropriate court for a review of such decisions. Application for review shall be made to the proper court of jurisdiction within 15 days after the filing of the board’s decision in the office of the Code Official.
