§ 33.02 ORGANIZATION.
   (A)   The city shall have one full-time Fire Chief whose primary duties shall be to supervise and administer the fire department in accordance with policies and procedures prescribed by the governing body or by the City Manager. The Fire Chief is vested with the authority to operate the department and those persons working for the fire department shall serve under the management, direction, command, and control of the Fire Chief. Specific examples of the Fire Chief’s powers and duties include, but are not limited to:
      (1)   Develop and implement department programs and procedures.
      (2)   The authority to formulate, enforce, and modify such orders, rules, regulations, policies, procedures or guidelines as shall be necessary for the orderly and efficient operation of the fire department.
      (3)   Direct any operation necessary to extinguish or control fire or perform other duties in coordination with other authorities having jurisdiction.
      (4)   Investigate fires, gas leaks, or other hazardous conditions and may take any action necessary to protect public health and safety and protect property or mitigate damage to property in the exercise of the chiefs duties.
      (5)   In exercise of the authority provided in subsections c and d, the fire chief may:
         (a)   Enter any property;
         (b)   Prohibit any person, vehicle or thing from approaching the scene;
         (c)   Remove or cause to be removed from the scene or other emergency any person, vehicle, or thing that the chief determines may impede or interfere with the operations of the department.
      (6)   Delegate authority to subordinates as needed for the orderly and efficient operation of the fire department.
      (7)   Enter into mutual aid and automatic aid agreements within the fiscal authority of the Fire Chief, and submit all others to the City Manager or City Council for approval.
      (8)   The Fire Chief, for purposes of applying ordinances related to the fire department, is synonymous with Chief of the Fire Department, Fire Code Official, and Emergency Management Director unless otherwise specified.
      (9)   The Fire Chief shall be the Authority Having Jurisdiction (AHJ) referenced in applicable National Fire Protection Association (NFPA) standards related to the operations of the fire
department and the powers and duties of the Fire Chief.
      (10)   All other such powers and duties assigned or delegated by the City Manager in accordance with the statutory, charter, ordinance, or regulatory authority of the City Manager so long as the Fire Chief’s primary duty is to the fire department.
   (B)   A Deputy Fire Chief shall serve as the “administrative assistant” as defined in 11 O.S. § 51-102(1).
   (C)   The type and number of positions in the Claremore Fire Department will be subject to the authorization of the City Manager and appropriations of the City Council.
