(A) No utility service provider shall construct any utility facilities located in the public way within the city unless such utility service provider shall have furnished all information required by the City Manager on an application form and received a valid permit from the city.
(B) Such permit shall be issued for the purpose of granting the permittee authority to use the public ways for the delivery of utility service, subject to the city's continuing authority to regulate use of its public ways.
(C) The permit may not be transferred, assigned, or disposed of by sale, lease, merger, consolidation, or other act of the grantee, by operation of law or otherwise, without the prior consent of the city.
