§ 40.02 DOCUMENT COPYING, MECHANICAL REPRODUCTION AND DOCUMENT SEARCH FEE.
   (A)   There is hereby established a fee in the following amounts for document copying and/or mechanical reproduction of city records which are subject to copying and/or mechanical reproduction under the Oklahoma Open Records Act, 51 O.S. §§ 24A.1 et seq., to-wit: $0.25 per page for documents having the dimensions of eight and one-half by 14 inches or smaller and $1 per copied page for a certified copy. The fee for all other records shall be the direct costs of the copying or mechanical reproduction of the record.
   (B)   If the request for the document copying and/or mechanical reproduction is solely for commercial purpose or clearly would cause excessive disruption of a city department’s or a city office’s essential functions, then in addition to the above fee, there shall be charged a document search fee as follows: If it is necessary to search the city’s records in order to locate the records requested, a reasonable fee to recover the direct cost of the record search, and, if necessary, for time spent reviewing and redacting records prior to production, may be charged if the request is solely for commercial purposes or clearly would cause excessive disruption of the city’s essential functions. The direct cost shall include, but not be limited to, the total cost of the individual’s or individuals’ time involved in the record search and reviewing and redacting, including but not limited to base salary, all benefits, taxes, burdens and pension costs.
   (C)   A written schedule of said fees shall be posted in the office of the City Clerk and in the office of each department and/or office where records subject to copying and/or mechanical reproduction are kept and in the office of the Rogers County Clerk.
   (D)   A document search fee shall not be charged when the release of said documents is in the public interest, including but not limited to, release to the news media, scholars, authors, and taxpayers seeking to determine whether those entrusted with the affairs of government are honestly, faithfully, and competently performing their duties as public servants, unless authorized by law.
   (E)   Each department head and/or officer shall designate a person or persons in their department and/or office who are authorized to release records of their department and/or office which are subject to inspections, copying, or mechanical reproduction under the Oklahoma Open Records Act and at least one such person shall be available at all times to release records during the regular business hours of such department and/or office. However, the release of such records shall be done in such a way so as to protect the integrity and organization of records and so as to prevent excessive disruption of the department’s and/or office’s essential functions.
