(A) License required. No person shall operate a sexually oriented business classified as “adult use-principal” defined in this chapter without having first secured a license as hereinafter provided. The owner(s) of a sexually oriented business in operation as of the effective date hereof, shall be required to file an application for a license as required by this chapter on or before the effective date; provided, however, that the city shall not be permitted to enforce this chapter against the owners until the city renders its decision on the application.
(B) Applications; content. An application for the license required by this section shall require the following information:
(1) The name, residence, phone number and birth date of the applicant, if an individual; and if a corporation limited liability company or partnership, the names, residences, phone number and birth dates of those owners/shareholders/members/partners holding an ownership interest in whatever form, voting or non-voting;
(2) The name, address, phone number and birth date of the manager of the operation, if different from the owners;
(3) The premises wherein the adult use is to be located;
(4) A statement detailing each gross misdemeanor or felony relating to a sex offense and/or the operation of adult uses and related activities of which the applicant (or in the case of a corporation, limited liability company or partnership the owners, shareholders, members, partners holding an ownership interest in whatever form, voting or non-voting) have been convicted, and whether or not the
applicant has ever applied for or held a license to operate a similar type of business in other communities;
(5) The activities and types of business to be conducted;
(6) The hours of operation;
(7) The provisions made to restrict access by minors;
(8) A building plan of the premises detailing all internal operations and activities;
(9) A description of merchandise, services or entertainment for sale in the premises;
(10) The means of restricting access by minors; and
(11) The property owner’s name and address and business owner’s name and address.
(C) Renewal applications. Applications for renewal licenses required by this chapter shall be completed and filed with the City Administrator no later than November 30 of the year preceding the year for which application is made. Any renewal application not completed and filed by that date shall be treated as a non-renewal application.
